These Terms of Service (“Terms”) govern your access to and use of the website www.themindpractice.in (the “Website”) and any clinical, assessment, training, consulting, or research services (collectively, the “Services”) provided by The Mind Practice, founded by Dr. Reena Sharma, Ph.D., and based in Ahmedabad, Gujarat, India (“we,” “our,” or “us”).
Please read these Terms carefully. By accessing the Website, booking a consultation, or engaging any of our Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Website or our Services.

4. Important Disclaimers
4.1 Not a Crisis or Emergency Service
The Mind Practice is not an emergency or crisis response service. We do not provide twenty-four-hour care. If you or someone you know is in immediate danger, experiencing suicidal thoughts, or facing a psychiatric or medical emergency, please contact emergency services immediately, go to the nearest hospital, or call a recognised crisis helpline such as iCall (+91 91529 87821) or the national mental health helpline KIRAN (1800-599-0019).
4.2 Website Content Is Not Professional Advice
Information published on our Website — including blog posts, articles, social media content, newsletters, downloadable resources, and book excerpts — is provided for general educational and informational purposes only. It is not a substitute for personalised professional psychological, psychiatric, medical, or legal advice. Reading our content does not establish a therapist–client relationship between you and The Mind Practice.
4.3 No Guarantee of Outcomes
Psychological care is collaborative and personal. While we apply evidence-based methods (including CBT, DBT, ACT, mindfulness-based approaches, and forensic CBT) and adhere to recognised professional standards, we cannot and do not guarantee specific clinical outcomes, recovery timelines, behavioural change, or results in legal, custodial, or rehabilitation contexts.
5. Booking, Fees, Cancellation, and Refunds
5.1 Booking
Appointments may be booked through our Website, by phone at +91 98115 10003, by email at connect@themindpractice.in, or through approved third-party platforms. Bookings are confirmed only upon receipt of confirmation from us.
5.2 Fees
Consultation, assessment, training, and consulting fees are communicated to you at the time of booking or through a separate engagement letter. Fees are payable in advance unless otherwise agreed in writing. We accept payment through methods notified by us from time to time.
5.3 Cancellation and Rescheduling
If you need to reschedule or cancel an appointment, please inform us as early as possible so the slot can be offered to another client. Late cancellations and missed appointments may be charged in full at our discretion, in line with the cancellation policy communicated to you at booking.
5.4 Refunds
Fees for completed sessions are non-refundable. Where a session has been paid for in advance and is cancelled by us, or cannot be delivered for reasons attributable to us, we will either reschedule or refund the relevant amount. Refund requests in other circumstances are considered on a case-by-case basis.
6. Client Responsibilities
To allow us to provide our Services safely and effectively, you agree to:

Provide accurate, complete, and honest information about your history, presenting concerns, medical and psychiatric care, and any relevant legal, educational, or occupational matters.

Inform us of any medication, ongoing treatment, prior psychological assessment, or risk factors relevant to your care.

Attend appointments punctually and engage actively in your care plan.

Treat the practitioner, our staff, and other clients with respect and courtesy.

Comply with practical instructions given to you in connection with your care, including any safety plan, between-session tasks, or referral guidance.

For online sessions, ensure a private, safe, and uninterrupted environment, and a stable internet connection.
7. Forensic and Court-Referred Services
We provide forensic and rehabilitation psychological services, including risk assessment, intervention with justice-involved individuals, court-referred evaluations, and our correctional rehabilitation programmes (such as the Samarth programme).
If you are engaging us in a forensic capacity, you acknowledge and agree that:

The role of the practitioner in a forensic context (assessor, evaluator, expert) is distinct from that of a treating therapist, and the duties of confidentiality differ accordingly.

Reports, assessment findings, and opinions prepared in a forensic capacity may be shared with referring authorities, courts, correctional institutions, legal representatives, or other parties as required by the referral or by law.

Forensic findings are based on the information available at the time of assessment and on the application of professional judgment to that information; they are not predictions of certain future behaviour.

Our scope of work, fees, and reporting obligations in any forensic engagement will be set out in a separate engagement letter or referral document, which forms part of these Terms in respect of that engagement.
8. Online and Tele-Consultation Services
Where Services are delivered through video, audio, or text-based platforms, you acknowledge that:

Tele-consultation is governed by the Telemedicine Practice Guidelines applicable in India and by professional and ethical standards relevant to your practitioner.

Online sessions may be affected by technological issues such as connectivity, audio quality, or platform outages, and may not be clinically suitable in all circumstances.

You are responsible for ensuring the privacy and security of your own environment and devices during online sessions.

Where we determine that online consultation is not appropriate for your concerns, we may recommend in-person consultation or refer you to another suitable service.
9. Confidentiality
Information you share in the course of clinical work is treated as confidential, in accordance with our Privacy Policy and the ethical and legal obligations governing psychological practice in India. There are limited circumstances in which we may be required to disclose information without your consent — for example, where there is serious risk of harm to you or others, suspected abuse of a child or vulnerable adult, or where disclosure is required by a court order or other lawful authority. These circumstances are described in greater detail in our Privacy Policy.
10. Intellectual Property
All content on the Website and in our materials — including text, graphics, logos, photographs, videos, blog posts, articles, downloadable resources, course materials, training manuals, workbooks, assessment tools (including the Criminogenic Thinking Profile and other proprietary instruments developed by Dr. Reena Sharma), book excerpts, and the design and layout of the Website — is the intellectual property of The Mind Practice, Dr. Reena Sharma, or our licensors, and is protected by Indian and international copyright, trademark, and other intellectual property laws.

In the case of clinical Services, where termination is initiated by us, we will, where appropriate and feasible, provide reasonable notice and offer suitable referrals to alternative practitioners or services.
You may discontinue use of the Website at any time. You may also withdraw from clinical Services at any time, subject to any commitments set out in your engagement letter.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, our Services, or applicable law. The revised version will be posted on the Website with a new “Last Updated” date. Continued use of the Website or Services after such update constitutes acceptance of the revised Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Subject to applicable law, any dispute arising out of or in connection with these Terms or your use of the Website or Services shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India.
